Terms of Service
These Terms of Service ("Terms") govern your use of drumsmidi.com (the "Service"), operated by an individual entrepreneur registered in the Republic of Kazakhstan. By using the Service, you agree to these Terms.
1. Description of Service
drumsmidi.com provides an AI-based web service for automatic transcription of drum audio tracks to MIDI format. Users upload audio files and receive generated MIDI files in return. The Service is available via a prepaid credit balance.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement.
3. Account and Payments
The Service operates on a prepaid balance model. Users top up their account balance (minimum $2 USD), and credits are deducted per transcription based on the audio duration.
New users receive a one-time free balance of 7 minutes of conversion time upon registration.
Credits are non-transferable and have no cash value. Credits expire 12 months after your most recent top-up or free trial grant.
4. Payments
Payments are processed by Paddle.com, which acts as the Merchant of Record for all transactions. By completing a purchase, you also agree to Paddle's terms and conditions. We do not store your payment card details.
5. Acceptable Use
You agree not to:
- Upload audio files to which you do not hold the necessary rights
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or otherwise misuse the Service
- Resell or redistribute outputs of the Service without our written permission
6. Intellectual Property
The Service, including its underlying technology and interface, is the property of drumsmidi.com. MIDI files generated from your audio uploads are provided for your personal or commercial use, subject to the rights you hold over the original audio material.
7. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that transcription results will be error-free or meet any specific accuracy requirement. Transcription quality may vary depending on audio content, recording quality, and complexity.
8. Limitation of Liability
To the fullest extent permitted by applicable law, drumsmidi.com shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
9. Refund Policy
Credits that have already been used for completed transcriptions are non-refundable. If a transcription fails (no output delivered), no credits are deducted for it.
Unused balance top-ups may be refunded within 14 days of purchase via our contact form, provided no credits from that top-up have been used.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, available at drumsmidi.com/privacy.
11. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the new Terms.
